Broadcom, a federal lawsuit pending in San Diego, provides several important reminders. In Qualcomm, a disclosure at trial that one of the litigants had withheld various highly relevant e-mails led to a finding by a magistrate that six retained attorneys should be sanctioned for failing to make a reasonable inquiry of their corporate client. The case showed how even litigants and attorneys who negligently commit a discovery violation can face potentially dire consequences.
