Truth and Consequences: The Fallout from Qualcomm

Description: Retained and in-house attorneys have known for some time the importance of ensuring that the client has made a diligent document search to comply with discovery requests, but a recent series of decisions in Qualcomm v. Broadcom, a federal lawsuit pending in San Diego, provides several important reminders. In Qualcomm, a disclosure at trial that one of the litigants had withheld various highly relevant e-mails led to a finding by a magistrate that six retained attorneys should be sanctioned for failing to make a reasonable inquiry of their corporate client. The case showed how even litigants and attorneys who negligently commit a discovery violation can face potentially dire consequences. Discussion Topics Will Include:

  • The risk to the corporate client from having provided incomplete discovery in a complex piece of civil litigation;
  • The need for retained and in-house counsel to “trust, but verify” the representations of client representatives about the thoroughness of a document search, and particularly of a search for relevant e-mail documents; and
  • The potential unforeseen consequences of erroneously withholding documents or failing to locate them during the discovery process.
